TYPES OF WRITS

a. Writ of Habeas Corpus:
Order the person holding someone in custody to bring the detainee to Court to determine if the detention is lawful or not.

b. Writ of Mandamus:
Commands a public agency or governmental body to perform an act required by law when it has neglected or refused to do so.

c. Writ of Prohibition:
Directs a Lower Court or tribunal to stop doing something that exceeds its jurisdiction.

d. Writ of Certiorari:
Orders a lower court to deliver its record in a case so that a higher court can review it.

e. Writ of Quo Warranto:
Challenges a person’s right to hold a public office.

EXAMPLES IN USE:

a WRIT of Habeas Corpus can be used to address unlawful detention. A WRIT of Mandamus can compel a government agency to issue a license or permit that it wrongfully denied. A WRIT of Execution can enforce a monetary judgement by allowing the seizure of a debtor’s assets.
